Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We collect personal data when you place an order, call our Customer Care team, sign up for our marketing communications, browse our website. We also collect data regarding your shopping habits and the pages and the products that you have viewed from your use of our website.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • "Identity Data" includes first name, maiden name, last name, username or similar identifier, title, date of birth and gender.

If you provide to us personal information belonging to someone else

  1. If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Who we disclose your personal information to as part of our services?
We may retain the services of external suppliers to help meet our business needs and may share your data with these suppliers. These suppliers have been selected after a rigorous evaluation process and chosen for their security, reliability and competence. They will process your data only under our instructions. We may disclose your personal data: 

  • to companies in our group and our affiliates; and

Any such third parties who process your personal data on our behalf are only permitted to process your personal data in accordance with our instructions and we take steps to ensure that the transfer and any on-going processing by those third parties is carried out securely and in accordance with applicable data protection laws.

Mention Me

We work with MentionMe as a 3rd party service provider who will place functional cookies should our customers interact with our refer-a-friend programme. As these cookies are functional, they are strictly necessary for the operation of the MentionMe platform and will be applied whether you accept or reject optional marketing cookies. These are all “strictly necessary” for the referral programme to function effectively.  As such, consent is not required under either PECR or GDPR.

The same is true in terms of Mention Me’s processing of personal data during the provision of the programme: Mention Me acts as a data processor, under our instructions and on the basis of legitimate interests, not consent.

Experian

Your personal data is shared with Experian Ltd for the purposes of managing a service called Club Canvasse, a home shopping and direct retailer data co-operative of which Desmond & Dempsey are members. By sharing information on what customers buy and pooling that with contributions from other members of the co-operative, the service allows Desmond & Dempsey to better understand our customers and to communicate with you more effectively. Please note, your personal information is not shared with any of the other members of the co-operative, and only aggregated data on the number and value of purchases is provided to members e.g. we will receive a report which states how many customers who have bought from us in the last 0-12mths, and who have also bought from other members of the co-operative in the last 0-12mths, or the last 24mths, last 36mths etc.  To understand more please click through to Experian’s website to understand more about their marketing services.

Klarna

In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

Marketing
If you opt-in to receive marketing information from us, we will send you messages by email, text and post to keep you informed of new arrivals, special offers, sales and promotions.

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which services and offers may be relevant for you.

You may opt out from receiving our marketing communication at any time by contacting our Customer Care team at info@piyei.com. Once you opt out, we will cease sending you marketing communications, however our system may take some time to adjust and you may still receive marketing emails before our system is fully updated.

Stopping marketing messages will not stop service communications, such as order updates.

We also work with Rakuten Advertising who may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purposes, such as personalisation of offers or advertisements, analytics about how you engage with websites or ads and other commercial purposes.   1. Where we store your personal information

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. They store your data on a secure server behind a firewall. You may view Shopify’s privacy policy at www.shopify.com/legal/privacy and cookie policy at www.shopify.com/legal/cookies.

We may also transfer your limited personal data such as name and e-mail address to Klaviyo for the purposes of generating highly-relevant marketing e-mails and other communications via Instagram and Facebook. Klaviyo’s system is integrated with Shopify and therefore Klaviyo may receive your personal information from us as well as from Shopify. If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA“). It may also be processed by staff operating outside the EEA who work for us or for one of our service providers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this cookie and privacy policy.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access and will ensure that any third party receiving your personal data adopts such appropriate measures necessary to safeguard your personal data.

Whenever we transfer your personal information out of the EEA, we ensure a similar degree of protection is afforded to it. We will only transfer your personal information to countries that have been deemed to provide an adequate level of protection for personal information by the European Commission.

Whenever we transfer your personal information out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
  • Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe.
  • Some of our suppliers and some group companies may be based in non-EU countries. Where this is the case, the transfer of your personal data to these countries is carried out in compliance with the guarantees provided by law.
  • The USA is not a country in respect of which there is a European Commission decision of adequacy. To transfer personal data from the EU to the US we use different tools which are available, such as contractual clauses, binding corporate rules and the Privacy Shield. Where we use providers based in the US, we may also transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US. The Privacy Shield allows your personal data to be transferred from the EU to a company in the United States, provided that the company there processes your personal data according to a strong set or data protection rules and safeguards. The protection given to your data applies regardless of whether you are an EU citizen or not. 

In order to be able to certify, companies in the US must have a privacy policy in line with the relevant privacy principles. They must renew their “membership” to the Privacy Shield on an annual basis. If they do not, they can no longer receive and use personal data from the EU. In this case, we will use the standard contractual clauses prescribed by the relevant data protection legislation in the EU for the purpose of transfers to the countries outsider the EEA.
